OLIPHANT
William Oliphant, 1st of Newton, second son of Colin, Master of Oliphant, obtained the west half of the lands of Newton from James Crichton of Frendraught in 1545. He had a Decreet in his favour from the Lords of Session against James Mercer of Dalgety for the spoilation of the lands of Newton on 30 July, 1558, in which he is styled as brother german to Laurence, Lord Oliphant,1 and is styled as father's brother to Laurence, 4th Lord Oliphant, in an Decreet obtained by this Laurence against George Sinclair, Earl of Caithness, for the removal of tenants from the lands of Thrumster on 21 November, 1587.2 He m. between 23 June, 1545, and 29 May, 1546, to Margaret, eldest daughter and coheiress of Andrew Oliphant of Berrydale, with whom he obtained the lands of Thrumster, in Caithness, and d. by May of 1593 when Laurence Oliphant of Newton, his eldest son and heir, sold the west-part of the lands of Newton to Sir William Oliphant. He was father of 1. Laurence Oliphant, 2nd of Newton and Berrydale, (see below). 2. John Oliphant, styled as son to William Oliphant of Newton when he witnessed a Bond by Alexander Vaus of Fornocht to Laurence, Lord Oliphant, of an annualrent of £80 from the lands of Dupplin on 5 June, 1585,3 and was served heir provisional to his brother Laurence Oliphant in the lands of Newton by his father on 19 December, 1586.4 He m. by 26 July, 1588, to Agnes Ochterlony, (she was widow of John Guthrie of Hiltoun by whom she had issue) when they are mentioned in a complaint raised against her deceased husband's family. 3. Colin Oliphant, living on 6 January, 1589.5 4. Andrew Oliphant, styled as fifth son of his father on 31 July, 1587. 5. Alexander/Janet Oliphant, one of whom was a child of William Oliphant of Newton (see Oliphant of Condie). Laurence Oliphant, 2nd of Newton and Thrumster, entered into a contract with his father on 19 December, 1586, that he should be infeft in the lands of Newton and which lands he sold to Sir William Oliphant in May of 1593. He m. to Mary, daughter of Andrew Rollo, 6th of Duncrub, is styled as deceased in an Instrument of Requisition by Sir James Scott of Balweary, in 1605 and was father of, 1. Laurence Oliphant, 1st of Gask, (see below). 2. John Oliphant, styled as brother to Laurence Oliphant, eldest lawful son of the deceased Laurence Oliphant of Thrumster, in an Instrument of Requestion by this brother to Sir James Scott of Balwearie for 1000 merks Scots on 8 April, 1605.6 He is styled in his brother Laurence's Testament of 1632 as his second brother and was father of,
3. William Oliphant, acted as Attorney to a Sasine by Laurence, Lord Oliphant, with consent of Lillias Drummond his wife, granting the lands of Ross to Laurence Oliphant, his brother, on 15 March, 1618, and is then styled as brother german to the said Laurence.7 He was admitted a Burgess of Perth by 1618, resided at the Orchard Mill of Gask and had a Wadset of the lands of Kildonie, in the parish of Forteviot, from James Oliphant of Muirhouse on 30 May, 1631.8 He m. to Janet Cuthbert, d. prior to September of 1639 and was father of, 3a} Laurence Oliphant, resided at the Orchard Mill of Gask and was retoured heir to his father on 3 September, 1639. He m. firstly to Margaret, daughter of John Drummond, of Dubheads, (c/m 10 May, 1641,) and had issue ; and secondly to Catherine, daughter of John Murray, Minister of Trinity Gask (she was widow of Laurence Mercer, Parson of Fossoway, who d. in January of 1658 and had issue). He d. in May of 16879 and was father of, 3b} Laurence Oliphant, styled as son of Laurence Oliphant at Orchard Mill of Gask in a Renunciation in 1675 and was witness to the christening of his nephew William, son of his brother William Oliphant at Dundee in July of 1678. He became a Writer to the Signet, m. firstly to Catherine, daughter of Patrick Murray, of Woodend, (c/m 24 April, 1667,) and had issue ; and secondly in around 1680 to Mary Hepburn, (she was buried in Greyfriars, Edinburgh, on 7 February, 1696,) and d. in September of 1690.10 He was father of, 3c} Laurence Oliphant, bap. at Edinburgh on 26 January, 1673, became a Merchant and dsp and Lisbon in March of 1709. 11
4. Margaret Oliphant, m. to Robert Scott, natural son of Robert Scott, 1st of Easter Balberton, (c/m 15 July, 1594,14). Laurence Oliphant, 1st of Gask, styled as eldest lawful son of umquhille Laurence Oliphant of Thrumster in an Instrument of Requisition in April of 1605 and had a charter for the lands of Ross from Laurence, Lord Oliphant, on 29 November, 1610. He obtained the lands and barony of Gask from Laurence, Lord Oliphant, and William Douglas, Earl of Morton, on 26 November, 1625.15 He m. by 10 June, 1606, to Lillias, daughter of Patrick Graham, 3rd of Inchbraikie, (she was widow of William Colville of Condie by whom she had issue), when she granted a Discharge of rights to the lands of Condie previously held by her deceased husband William Colville, and d. on 22 July, 1632, being buried in the church at Gask. He was father of, 1. Sir Laurence Oliphant, 2nd of Gask, (see below). 2. James Oliphant, 1st of Souterton, had an Instrument of Sasine from his brother Sir Laurence Oliphant of Gask for the lands and town of Soutertoun on 18 December, 1655, and m. by this date to Janet, only daughter and heiress of Henry Reddoch of Thomperon.16 He d. in late February or early April of 1676 he being buried in "the Laird of Gask, his brother's, sepulchre" on 5th April of that year and was father of, 2a} William Oliphant, 2nd of Soutertoun, had a Disposition from his father as his eldest son and heir on 28 February, 1672, and had from his mother Janet Riddoch a Disposition of her liferent from the lands of Souterton in 1687. He m. to Beatrix, daughter of Patrick Drummond, of Dubheads, (c/m 14 November, 1674), d. by 1702 and had issue,
3. William Oliphant, styled as son to Laurence Oliphant of Gask in Bond by his father in favour of Laurence Oliphant, his eldest son, on 30 January, 1632.19 In 1635 he is styled as then residing in Germany and was father of, 3a} William Oliphant, apprenticed to Andrew Reid, Merchant in Perth, on 24 May, 1656. In a discharge for the fee of this indenture he is styled as son of William Oliphant, brother german to Sir Laurence Oliphant, of Gask, and on 5 September, 1649, he had a Charter from Patrick Drummond of Dubhheads for the lands of Easter Craigton in which he is styled as only son of William Oliphant, brother of Laurence Oliphant of Gask.20 He m. to his cousin Katherine, daughter of Patrick Oliphant, Minister at Unst, and dsp. 4. Patrick Oliphant, styled as brother german to Laurence Oliphant of Gask in a Precept of Sasine by James Graham, Earl of Montrose, in favour of the said Laurence for the lands of Culgask on 22 November, 1632,21and was appointed Minister at Unst, in Shetland. He m. to Margaret, daughter of James Mowat, of Barroforth and Ure, and had issue, 4a} James Oliphant, of Ure, obtained these lands and m. to Janet Dunbar (she d. in 1682) and had issue,
4c} John Oliphant, of Ure, succeeded his father and sold his lands to Arthur Nicolson on 11 June, 1777. 4c} Charles Oliphant, apprenticed to Walter Davidson, Saddler in Edinburgh, on 28 August, 1717, and served as a Lieutenant in the Regiment of Lord John Drummond during the Jacobite uprising of 1745/46 was taken prisoner and sentenced to death although this was averted through the intercession of Brodie of Brodie with transportation to America being the lesser sentence. He m. to a Drummond, became an Innkeeper at Kingston, Isle of Jamaica, where he d. in 1750.22 He had issue, 4d} James Oliphant, styled, with his sister Janet, as son of his father and then residing in North Britain.
4a} Lillias Oliphant, acted as executor to her brother Thomas in 1708 and in which she is styled as his sister and daughter to the deceased Mr. Patrick Oliphant, Minister in Shetland. She is also stated to have then been resident at Souterton. She appears to have m. to a Sutherland and to have had issue.
5. Alexander Oliphant, styled as a natural son when he appears as witness to the marriage contract of John Murray, Minister of Kinkell, and Catherine, daughter of the deceased William Colville, of Condie, on 9 February, 1621. He is mentioned in his father's Testament in 1632. 6. Lillias Oliphant, m. to Sir James Murray, 5th of Tibbermuir, (he was widow of Marjory, daughter of William Colville of Condie, and m. thirdly on 15 January, 1624, after the death of Lillias, to Anna, daughter of Sir Andrew Melville of Garvock), and had issue. 7. Jean Oliphant, m. firstly in 1629 to John Drummond, 8th of Pitkellony, (he was killed at Charlemonth, Ireland, in 1644), and secondly to George Drummond, younger son of John Drummond, 2nd of Kildees, and had issue. 8. Margaret Oliphant, styled as second lawful daughter to Laurence and m. to Alexander Inglis, of Craigmakerran (c/m at Ross on 23 February, 1627,24). She d. on 30 May, 1663, and had issue. Sir Laurence Oliphant, 2nd of Gask, b. in around 1608, was retoured heir to his father in the lands and barony of Gask on 25 August, 1632, and for which he had a Charter of Confirmation on 9 March, 1633. He had a Disposition from William Blair of Williamston for the three-quarter part lands of Williamston and three-quarters and two-eigths of the lands Souterton on 11 June, 1652,25 and m. to Lillias, daughter of Patrick Oliphant, 6th Lord Oliphant (c/m 19 February, 1634. She d. in January of 1669). He was Knighted by King Charles II. in 1650 and d. in mid-1679 (his last Will and Testament was dated 5 June, 1679). He was father of, 1. Patrick Oliphant, 1st of Williamstone, b. in around 1635 and had a Disposition for the lands of Easter Craigs from Patrick Drummond of Dubhheads on 26 January, 1682.26 He had a Charter of Confirmation under the Great Seal for the lands of Williamstone, Souterton, Easter and Wester Dubhheads, Hunterton and Craigmakerran on his father's resignation 29 July, 1687,27 and m. to Margaret, daughter of John Murray, Minister of Trinity Gask. He d. in 1694 and was father of,
1a} Laurence Oliphant, apprenticed to Robert Ranken, Skipper in Dundee, on 29 July, 1697, and which indenture he subsequently broke. He became a sailor on board the Caledonia and d. during the Darien adventure.28
2. Laurence Oliphant, 3rd of Gask, b. in around 1638 and to whom his father granted a Disposition for the lands of Gask in 1659 and which were confirmed by a Crown Charter in 1663. He m. to Anne, second daughter of Sir George Preston of Valleyfield, (c/m at Edinburgh on 19 July, 1661. She m. secondly on 17 July, 1678, to Sir James Hay, of Pitfour, who was then widow of Jean, daughter of Sir Andrew Hay, of Keilour,) and d. in August of 1672.30He had issue, 2a} George Oliphant, 4th of Gask, succeeded his father and m. firstly at Ballingray on 1 July, 1681, to Anna, daughter of John Malcolm, of Balbedie, (she d. in December of 168331). He m. secondly, within the space of four months following the death of his first wife, to Jean, daughter of John Balfour, 3rd Lord Burleigh, (c/m 26 April, 1684. She m. secondly in May of 1688 to Sir Robert Douglas, 5th of Kirkness, and had issue,) and d. on 7 September, 1684. He was father of,
3. Andrew Oliphant, styled as third lawful son to Sir Laurence when he was apprenticed to Robert Wallace, Writer in Edinburgh, on 3 January, 1659, and dsp in 1665. 4. Archibald Oliphant, apprenticed to David Scott, Apothecary in Edinburgh, on 7 December, 1664, and m. at Edinburgh on 19 August, 1669, to Anna, daughter of George Drummond, Town Treasurer of Edinburgh (c/m 2 August, 1669. She d. in 1694). He became an Apothecary Burgess, by right of his Master, David Scott, on 8 March, 1671, and dsp prior to 1686. 5. David Oliphant, apprenticed to John Glas, Merchant in Perth, on 21 July, 1664, and was serving as Lieutenant in the 7th Company of the Perthshire Militia in 1680. He dsp at Edinburgh on 2 November, 1707, and was buried in the Greyfriars Churchyard. 6. Lillias Oliphant, m. to James Graham, 4th of Orchill, (c/m 3 November, 1668. He d. on 14 March, 1725), and had issue. 7. Anna Oliphant, m. to Colin Campbell, 4th of Lagvinsheoch and Monzie, (c/m 5 August, 1672. He was b. on 2 November, 1635), and d. on 17 October, 1732. She was buried next to her husband in Monzie churchyard and had issue. 8. Elizabeth Oliphant, m. on 8 April, 1676, to her cousin Gavin Drummond, 1st of Belliclone, younger son of George Drummond and Jean Oliphant, daughter of Laurence Oliphant, 1st of Gask, and had issue. James Oliphant, 2nd of Williamstone 5th of Gask, had a disposition of the lands of Williamstone from his father in 1689 and for which he had a Charter of Confirmation under the Great Seal dated 14 August, 1696.33 He succeeded to the lands of Gask on the death of his cousin William Oliphant in 1704, and had a Decreet of Adjudication against his cousin Laurence Oliphant of Souterton for the lands of Souterton in satisfaction of payment of a Heritable Bond dated 6 September, 1708, for 1,200 merks Scots which had remained unpaid.34 He m. on 16 July, 1689, to Janet, eldest daughter of Anthony Murray of Woodend, and sister and heiress of Thomas Murray, of Woodend, and d. at Gask on 10 April, 1732.35 He was father of, 1. Laurence Oliphant, 6th of Gask, (see below). 2. Thomas Oliphant, b. at Williamstone on 30 May, 1693, became a Writer and was active in the Jacobite rising of 1715. He m. to Janet, daughter of Patrick Meldrum, of Leathers, (she was widow of Laurence Oliphant, 4th of Condie, by whom she had issue ; and of David Drummond, 4th of Innermay, by whom she left no issue), and dsp on 6 September, 1740. He was buried at Gask on 9th September. 3. James Oliphant, b. at Kinloch on 29 March, 1699, and m. at Kilspindie on 5 June, 1731, to Janet, daughter of Joseph Austin, of Kilspindie (she was c. at Kilspindie on 19 January, 1708). He was a merchant in Perth, was a Jacobite supporter during the 1745 uprising and d. in May of 1765.36 He had issue, 3a} James Oliphant, settled in Newcastle where he became a Doctor. He m. at Gateshead, Durham, on 31 July, 1755, to Mary, only child of William Erskine alias Farquharson, Surgeon in Newcastle,37 and had issue, 3b} John Oliphant, who joined his uncle in Jamaica and where he m. in 1790 to his cousin Janet, daughter of Laurence Oliphant. He acted as executor to his father in 1793 and in whose Testament he is stated to be "late of Tobago, Planter then residing in Glasgow."38 He had issue,
3b} Ebeneezer Oliphant, b. on 29th August and c. at Newcastle-Upon-Tyne on 6 September, 1769.
3b} James Oliphant, practised as a Doctor in Jamaica and m. on 23 November, 1758, to Sarah Luttman. He d. in 1803.
4. Anthony Oliphant, b. at Williamstone in March of 1701 and d. on 23 March, 1702. 5. William Oliphant, b. at Williamstone on 23 September, 1703, and was apprenticed in 1721 to James Smith, Surgeon in Perth. He d. without apparent issue at Kingston, Jamaica, on 21 June, 1738. 6. Patrick Oliphant, b. at Williamstone in January of 1707, and was apprenticed in 1722 to Archibald Arnot, Surgeon in Kirkcaldy. He afterwards continued his studies at Lyden and in 1729 entered the service of the East India Company as a surgeon in which service he d. at Baghdad on 20 December, 1750, leaving no issue. 7. Alan Oliphant, b. and d. in 1711. 8. Ebeneezer Oliphant, b. at Gask on 7 March, 1713, was apprenticed to James Mitchellson, Goldsmith in Edinburgh, on 13 September, 1727, and was admitted a Goldsmith Burgess of Edinburgh on 8 March, 1737. He presented Prince Charles Edward Stewart with a Silver Canteen on his entry into Edinburgh and it was mainly due to his fortune that the family managed to purchase from the government the forfeited Gask estate which was afterwards restored to it's rightful proprietors. He m. to Æmelia, daughter of Alexander Belches of Innermay, (she was buried in Greyfriars on 9 December, 1779), d. on 26th and was buried in Greyfriars on October, 1798. He was father of,
9. Jean Oliphant, b. at Williamstone on 14 November, 1690, and d. on 17 March, 1718, dsp. 10. Margaret Oliphant, b. on 22 December, 1694, and dsp in 1712. 11. Anne Oliphant, b. on 22 April, 1696, and m. on 22 January, 1719, to John Drummond, 10th of Colquhalzie. She d. on 6 April, 1740, and had issue. 12. Lillias Oliphant, b. on 16 August, 1697, and m. firstly on 7 August, 1718, to Laurence Oliphant, 5th of Condie, and had issue ; and secondly at Perth on 31 May, 1729, to John Bethune, Comptroller of Customs. She d. the day following that of her father's demise being 11 April, 1732. 13. Helen Oliphant, b. on 8 July, 1702, and d. in September of that same year. 14. Janet Oliphant, b. at Edinburgh on 13 January, 1705, and dsp in April of 1723. 15. Katherine Oliphant, b. at Edinburgh on 18 May, 1709, and m. on 18 April, 1736, to Robert Graham, 11th of Garvock (he d. on 5 May, 1797). She d. in 1775 and had issue. Laurence Oliphant, 6th of Gask, b. on 29 December, 1691, and entered into a contract with his father whereby he bound himself to pay his father's debts and children's provisions along with a Bond for £2000 in return for a Disposition for the lands of Williamston and Cowgask on 26 September, 1719.39 He m. on 12 September, 1719, to Æmelia Anne Sophia, daughter to the William, 2nd Lord Nairne (she d. on 18 March, 1774), was an active Jacobite supporter in the risings of 1715 and 1745 and was present in the Regiment of Viscount Strathallan at the battle of Culloden on 16 April, 1746. Both he and his son Laurence, younger of Gask, afterwards made their escape to Sweden and later returned to his previously forfeited estates which had been purchased on his behalf on 17 February, 1753, by Ebeneezer Oliphant, his brother, Oliphant of Condie, Campbell of Monzie and Graham of Inchbraikie. He d. on 1 April, 1767, and was father of, 1. Laurence Oliphant, 7th of Gask, (see below). 2. Andrew Oliphant, b. on 29 June, 1730, and d. on 22 January, 1734. 3. Margaret Oliphant, b. on 22 June, 1720, and m. on 5 June, 1758, to Patrick Graham, 8th of Inchbraikie (he d. in 1796). She d. on 6 July, 1785, and had issue. 4. Janet Oliphant, b. on 21 July, 1721, and m. in the Swedish Chapel, Paris, on 1 January, 1758, to William MacGregor alias Drummond of Balhaldie. She d. on 8 December, 1765, and had issue. Laurence Oliphant, 7th of Gask, b. on 25 May, 1724, and followed his father in the Jacobite campaign of 1745 during which he served as one of the aide de camp to Prince Charles. Both he and his father were present at the battle of Culloden on 16 April, 1746, and afterwards made their escape to Sweden where they stayed in exile until they could regain the family estates. He later m. in exile in France on 9 June, 1755, to Margaret, daughter of Duncan Robertson, 4th of Drumachuine and heir-male of Strowan (she d. on 18 March, 1774). Despite having regained his estates and having thus been compelled to live under the then monarch King George, he unwaveringly adhered to the exiled Stewarts and d. on 1 January, 1792. He had issue, 1. Laurence Oliphant, b. at Drummond's House, London, on 27 September, 1756, and d. at Corbeil "At half ane hour after six in the morning." on 8 October, 1757. 2. Laurence Oliphant, 8th of Gask, (see below). 3. Marjory Ann Mary Oliphant, b. at Gask on 22 October, 1762, m. in 1791 to Alexander Stewart, 9th of Bonskeid, (he was widow of Jean Bisset), d. at Perth on 19 June, 1819, and had issue. 4. Æmelia Ann Sophia Oliphant, b. at Gask on 19 August, 1765, and m. at Findo-Gask on 29 July, 1794, to Charles Stewart, 8th of Dalguise (he was widow of Grace, daughter of Robert Stewart, of Ballechin, whom he m. on 16 April, 1786). She d. on 9 April, 1808, and had issue. 5. Carolina Oliphant, b. at Gask on 16 August, 1766, and named after Prince Charles Edward Stewart. She m. her cousin Major William, attainted Lord Nairne, who, in 1824, was restored to his family peerage of Lord Nairne (he d. on 9 July, 1830). She d. on 26 October, 1845, being best remembered for her song-writing capabilities. 6. Margaret Euphemia Janet Æmelia Oliphant, b. at Gask on 29 July, and bap. at Findo-Gask on 1 August, 1770. She m. in April of 1811 to Alexander Keith of Dunnottar and d. on 10 September, 1847, having had issue. 7. Charles Oliphant, b. at Gask on 8th June, was bap. at Findo-Gask on 9 June, 1772, and d. at Gask on 23 July, 1797. Laurence Oliphant, 8th of Gask, b. on 29 April, 1768, and m. at Blairgowrie on 15 November, 1795, to Christian, second daughter and eventual heiress of Dr. Joseph Robertson and Rachel, heiress of James Blair of Ardblair, (she d. at Clifton on 24 April, 1827). He d. at Paris in June of 1819, and was father of, 1. Laurence Oliphant, 9th of Gask, (see below). 2. James Blair Oliphant, 10th of Gask, (see below). 3. Rachel Oliphant, heiress of Ardblair, (see below). 4. Margaret Oliphant, bap. at Findo-Gask on 21 August, 1799, and m. at Rood Ashton on 26 May, 1830, to Thomas Kington of Charlton House, Somerset, (he d. in 1857). She d. at Teignmouth on 14 September, 1839, and had issue,
5. Christian Oliphant, bap. at Findo-Gask on 12 October, 1800, d. unmarried at Malvern Wells on 28 June, 1830. 6. Æmelia Oliphant, bap. at Findo-Gask on 21 November, 1801, and d. unmarried at London on 18 October, 1820. 7. Harriot Oliphant, bap. at Findo-Gask on 22 December, 1802, and d. unmarried at Gask on 6 August, 1822. 8. Carolina Oliphant, b. and bap. at Muthill on 16 January, 1807, and d. at Clifton on 9 February, 1831. Laurence Oliphant, 9th of Gask, bap. at Findo-Gask on 6 May, 1798, and was retoured heir to his father in the lands of Gask on 29 January, 1821. He dsp at Torquay on 31 December, 1824. James Blair Oliphant, 10th of Gask, bap. at Findo-Gask on 3 March, 1804, and was retoured heir to his brother Laurence on 31 October, 1831. He was retoured heir to his "remote cousins" Francis, 10th Lord Oliphant, and William Oliphant of Newton, brother of Laurence, 3rd Lord Oliphant, on 23 August, 1839, and m. on 20 October, 1840, to Henrietta Gillespie, eldest daughter and heiress of James Gillespie Graham of Orchill, (she dsp on 9 December, 1886). He dsp at Leamington on 9 December, 1847. The terms of his Will were the cause of a long legal battle between various contending parties including Oliphant of Condie as he had stipulated that the estate should pass to the heir male of the family. However, with all known male descendants at that time being dead with no surviving male issue, notices were placed in newspapers seeking anyone of descent especially those come from Dr. James Oliphant, younger son of James Oliphant, of Gask. After some years with no success there emerged the Dutch Oliphants, father and son, with a remote but lawful claim with whom a bargain was reached which gave them the rental of the estate for the duration of their lives with the lands to revert to the nephew of the last Laird, Thomas Kington Oliphant, upon their death. Rachel Oliphant, of Ardblair, bap. at Findo-Gask on 27 January, 1797, and was retoured heir to her mother in the lands of Ardblair on 5 April, 1849, at which time she was residing at Coombank, Bristol. She succeeded her brother James in the lands of Gask upon his death in 1846 and d. unmarried at Bath in 1864.
